Toho Terms and Conditions

Welcome to Toho, a service provided by Toho Technologies Inc. ("Toho Technologies," "we," "us," or "our"). By using our mobile application ("Toho") and any associated services, you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully.

1. Acceptance of Terms

By accessing or using Toho, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not use our services.

2. Changes to Terms

Toho Technologies reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting. Your continued use of Toho following the posting of changes constitutes your acceptance of those changes. It is your responsibility to review these Terms periodically for updates.

3. Services

3.1 Service Offerings

Toho offers on-demand home services that connect users with service providers for a variety of tasks. Current service tiers include:

  • Tier One: Services performed outside the client’s house, such as landscaping, mowing the grass, shoveling driveways, and similar tasks. These Pros do not need to enter the client’s home.
  • Tier Two: Services that require entering the client’s home, such as plumbing, electrical work, painting, babysitting, rearranging furniture, hanging TVs, tiling, flooring, and similar tasks. Pros in this tier must undergo a background check and possess the necessary licenses for the work they perform. However, some tasks, like rearranging furniture, do not require licenses or insurance but still require a background check before Pros are matched with Clients.
  • Tier Three: Services similar to Tier Two but taking longer than four hours, such as construction and roofing. Pros in this tier are subject to the same requirements as those in Tier Two.

3.2 Service Provider Requirements

Pros on Toho are independent contractors and not employees of Toho Technologies. They must meet certain requirements to provide services:

  • Background Checks: Pros entering a client’s premises must undergo a background check.
  • Licensing: Pros performing licensed work must upload their licenses for verification. Toho Technologies will conduct a thorough check of the eligibility of each license through a third-party verification system.
  • Insurance: Pros providing Tier Two and Tier Three services must have appropriate insurance coverage.
  • Business Documentation: If a Pro has a registered company, they must upload the articles of incorporation or their business registration documents.

4. Client Registration

4.1 Registration Process

Clients can register for Toho by providing accurate and complete information, including their payment method. Client accounts will be activated immediately upon completion of the registration process.

4.2 Payment Information

Clients are required to enter valid payment information during the registration process. This information will be securely stored and used to process payments for services booked through Toho.

5. Pro Registration

5.1 Registration Process

Pros wishing to offer services through Toho must undergo a thorough verification process. This process includes submitting personal information, payment details, and relevant documentation such as licenses and insurance.

5.2 Verification Process

The verification process for Pros can take between 3 to 10 business days. During this period, Toho Technologies will review and validate submitted documents to ensure compliance with our standards. Pros will be notified once their registration is complete and they are approved to offer services on the platform.

Toho Technologies partners with Verification Canada, a third-party Canadian company that uses state-of-the-art technologies for identity and background verification. Every Pro requiring verification will receive a unique state link via the email address they used to register. They must complete the verification process through this link.

There is a small fee of $23 for verification. However, Toho will reimburse this fee to Pros after they successfully complete five (5) jobs through the Toho platform.

6. Eligibility

6.1 Age Requirements

To use Toho:

  • Tier One Services: Users must be at least 16 years old.
  • Tier Two and Tier Three Services: Users must be at least 18 years old.

6.2 Authority

By using Toho, you represent and warrant that you have the right, authority, and capacity to enter into these Terms and to abide by all the terms and conditions set forth herein.

7. User Accounts

7.1 Account Creation

To access certain features of Toho, you must register for an account. You agree to provide accurate and complete information and to update such information as needed.

7.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Toho Technologies immediately of any unauthorized use of your account.

8. Payments

8.1 Payment Processing

Toho Technologies uses Stripe as its payment processor to handle all transactions securely. Stripe is a trusted third-party service that ensures fast and reliable payment processing. At this moment, there are no additional charges for using Stripe.

8.2 Service Provider Compensation

For each completed task, Toho Technologies will deduct a total fee of 25%, which includes both Toho platform fees and payment processing fees. The remaining balance will be forwarded to the Pro. Payments to Pros are processed once a week, and Pros must register their banking information within the Toho platform to receive payments.

Toho Technologies may update its fee structure in the future, and any changes will be communicated to users in advance.

9. Cancellations and Refunds

Cancellations and refund policies will be handled on a case-by-case basis. Toho Technologies reserves the right to issue or deny refunds based on the findings of a review.

10. Privacy and Data Security

10.1 Data Collection

Toho Technologies collects information from Pros and Clients to facilitate the provision of services.

10.2 Data Security

We implement industry-standard security measures to protect collected information. However, we cannot guarantee absolute security of your data.

11. User Conduct

You agree not to use Toho for unlawful purposes or to harm others. Prohibited conduct includes:

  • Violating any laws or regulations.
  • Impersonating any person or entity.
  • Harassing, threatening, or defaming others.
  • Providing false information during the registration or booking process.

12. Intellectual Property

All content on Toho is the property of Toho Technologies or its licensors and is protected by intellectual property laws.

13. Disclaimers

Toho is provided "as-is" and "as-available." We do not guarantee uninterrupted or error-free service.

14. Limitation of Liability

Toho Technologies is not liable for indirect, incidental, special, or consequential damages arising from your use of Toho.

15. Indemnification

You agree to indemnify and hold harmless Toho Technologies, its officers, employees, and agents from any claims arising from your use of the service.

16. Governing Law

These Terms are governed by the laws of Ontario, Canada.
